"It appears quito clear that Gaudin did not at any time intend to iniure his country or benefit the enemy, and that he merely failed to obsorv* certain regulations, the breach ot wliK'H involved no risk to lives, property, or interests of any kind of any person or the community, and that failure to oh - serve such regulations wasdue: •.!)
