Mr. Justice Stringer delivered judgment in the caise in which the widow of Francis Smith/a victim of the Kaimata tragedy, sued his employers^ the New Zealand Express Company, for compensation for his death when engaged on behalf of tlie company. The judge held that Smith's death -wasi not directly due to any special risk arising, from the nature of his employment, and gave judgment for the defendant with costs.
