A REFUND CLAIMED.
Edward Sears, cycle and motor importer, claimed £2 from George Everard, advertising contractor, being refund of amount paid for an advertisement.
: Mr. Harley appeared for the plaintiff. No notice of defence was filed.
Mr. Harley suggested that the Justices should hear the circumstances and put plaintiff in the witness box. Plaintiff stated tha,t defendant canvassed him for an advertisement to cost £2, -and submitted a design which was to be placed in all the bedrooms of the Masonic Hotel. "Witness consented to advertise, and defendant collected £1 on account. A few days later he called and said that the advertisement was up, at the same time .collecting the other pound. Plaintiff learned that Mr Baigent, licensee of the Masonic Hotel, would not allow the advertisements to be put up, as they were not framed. Plaintiff said he spoke to Constable Townsend about it, and he saw defendant, who agreed to put up the advertisements in tke Trafalgar Hotel. Plaintiff declined to allow his advertisement to be put up in the Trafalgar Hotel, and asked for a refund of the £2, which was not forthcoming. Judgment was given for the amount claimed, with costs, 11s.
