Carl Howard Irving was granted a decree nisi in divorce on the ground of desertion. He gave evidence that in 1908, .when a dental student, he married a New Zealand girl who was a student at the Garcia School of Music. Two days later his wife left for . New Zealand, promising to return and have the ceremony re-performed if her father consented. Failing her return he visited New Zealand, and hi.s wife infoumed him that she never intended to live with him.
