Wellington, July 24. At the Court of Appeal to-day, the case of Head Brothers Ltd. v. Cowie Company was heard. The appeal is from the. decision of His Honour Mr. Justice Cooper, by way of appeal from the registrar of patents allowing Cowie registration of trade mark of a bull's head for beer bottles. Appellants have as a trade mark a bull dog's head, and claim that abull's head is likely to deceive the public, nud lead them to think they were getting bull dog brand. "•' " ; Mr. T. Young appears for appellant and Mr. Vori Haast for respondent. Mr. Yon Haast said the bull's head label had been used for fifteen years, and there was no evidence to show that anyone had been deceived. At the conclusion of the argument the Court unanimously dismissed the appeal.
