This was an action to make good a caveat filed by the plaintiff corporation against the bringing under the prriyiftion.s of the Land Transfer Act ceitain land in the Tadmor Valley. Quotums of considerable importance and of a (highly technical character in l'rgard to old surveys1, etc., were involved in the hearing. After hearing the c\ k'enee. of two witnesses for tV plaintiff Council, His Honour considered that the action was one in which a reasonable compromise should be arrived at. The land itself was n-it of extreme value excepting as forming • tho frontage to the defendiin"r;

The Coum-il undertook to withdraw the caveat le, part of the land involved, s.rd the defendant agreed to withdraw his applicatio>n in flespset to the otlier portion of the land, thus giving the dofciula.nt a froiitirro to the "vis+ina; road for part of 'his section. His Honour, in regard to costs, thought that each party should pay his own costs, exeenting the expenses of witnesses for both sides, and these were to ho totaled and equally divided. Mr Hayes appeared for the plaintiff and Mr Magimiity for the defendant.
