[United Pkess Association.] i Palmerstftn North, May, 80. | Mr Justice Cooper was occupied all day in rehearing the .case agamst Archibald Muir, charged with stealing tjM'queg,. valued at about £800, from tho National Mortgage Company in connection with the Longburn freezing works, and dealing with alleged purchases of tallow, bones, etc. The jury twice before disagreed. After a retirement of three hours they returned a verdict of guilty on the charges of staling throe cheques in the series. Tlte jury found that Iversoii, to whom the cheques were made out, was a fictitious person. The jury added a rider recommending that the prisoner bo -leniently dealt with on account of his age and previous good character, and the laxity with which the National Mortgage Company had conducted its business at Longburn. . Counsel for the accused raised the point that" the evidence 'was in tho direction not of theft but of false pretences. He asked for leave to appeal. His Honour granted leave to appeal, and sentence was deferred until t.lie Appeal Court had dealt with tlie point raised)
