CLAIM FOR VALUATION FEE,
John Langley Adams, farmer, of Stoke, claimed from John Milne, sheep farmer, of Island Bay, the sum of £10 10s valuation fee in connection with the Enner Glynn estate. .Mr A. T. Maginnity appeared for plaintiff, and Mr Harley (instructed by Mr A. Dunne, of Wellington) for the defendp'laintiff stated that he received letters" from defendant and from defendant's solicitor (Mr Dunne) instructing him to make a valuatum of the Enner Glynn property. Hpju-spected-the land twice, and visited the Ground a* third time. Defendant wanted a speciaH valuation, which he made, and forwarded a.n account to defendant for £10 10s. The charge was a very reasonable one. By Mr Hariey : 'He was not aware that the usual fee for valuation in this district was £2 2s to £3 3s. J Sharp, junior, land agent, considered that the charge for a special valuation was a very reasonable charge. A. H. Bisley and John Porter Harris gave corroborative evidence. Evidence of witnesses taken at Wellington was taken as read. Defendant's agent stated that the charge was not unreasonable, but defendant held that £5 6s /would have been a reasonable charge. The Magistrate said that there was no dispute in regard to the engagement of Mr Adams to value the property, and the evidence went to show that tho charge was reasonable. Judgment would be given for plaintiff for the amount claimed, with costs £5. Us.
