CHARGE OF ASSAULT.
Walter Ernest Haines was charged with assaulting Elizabeth A. L. Mackay by striking her on the chest with bis clenched Mat, and knocking her down, Mr Maginnity appeared for informant. Accused pleaded not guilty.
Informant in her evidence stated that on Wednesday, llth March, Haines came to her residence, and walked in. He asked her daughter (Mrs Hain>sj to go with him to see a three-. roomed hou3B, and she refused. Accused seized her by the arm, and said be would make her go with him. Witness interfered, and said he must not ill|use her daughter, and tben be struck her m the chest, and she fell down. Witness told her grand daughter, Grace Oliver, to go and bring a ruler from the bedroom (with whicb she intended to protect herself), and on her doing so, Haines seized it, and some ornaments were knocked off a shelt. Accused bad visited her house several times since, at all "hours of the night, and disturbed the neighbors.
In reply to questions by accused, witness denied that she had invited him to come in nnd sit down, and also that she had said if he didn't get out of tae house in two mimites she would "put his light out."
She admitted having a revolver in the house, and said she could have used it twenty times if she had liked. :
Grace Oliver, 14 years of age, • a daughter of Mrs Haines, gave corroborative evidence.
Accused called Constable _ Fitzsimmons, wbo stated that riaines came to the Police Station on Wednesday evening, with 'his face' and shirt covered with blood. He had two "lumps on Jthe head. He brought the ruler with him. Mrs^Mackay, re-called, denied that she struck accused with the ruler.
