[UNITED FBISS ASSOCIATION.] Wellington, October 13. In the Supreme Court the proprietor of the Yiotoria Hotel, Petone, appealed against a conviction by the Resident Magistrate for damages to footpath through the existence of a cornice on the premises, causing the rain water to drop on the path and wear it away. His Honor said he was of opinion that the: information sufficiently charged an offence under section 340, subsection 7, of the Municipal Corporations Act. He was also of opinion that an act within the subseotion referred to had been disclosed, and that • the ereotion of the cornioe could not be justified. He quite agreed with the finding of the Magistiate than an offence had been committed, but thought toe defendant bad been hardly used. The conviction was affirmed, but the penalty reduced from £5 Is to Is, the defendant to pay costs.
