H, Harley—Mr Fell for plaintiff, and Mr Pitt for defendant. Claim for £18 16s Id, balance due on an agreement for plaintiff to sail the schooner Pet and providore her at £20 per month. The vessel left Nelson on ttie 19th February, proceeded to Motupipi, took in a load of coal for Blenheim, having to wait some days for it, owing to adverse weather, and not being able to get over the Wairau bar, it was the 15th of March before the ss Neptun* undertook to tow her up after she had sailed over the bar, but as she grounded on the. mainland, three days more elapsed before she reached her destination. After unloading, a week was"spent waiting -for a' cargo of wheat, and she got across the bar again on theSOth, and after a fortnight's buffeting by head winds, in Nelson, having taken 62 days o*n the round trip, with waits. ; ; 'iThe defendant then paid £28 8s 9d, and .told plaintiff to go, and that he had all he would get. Plaintiff contended that he was not discharged till he got all his money, and for the time he was in charge in the port he charged 10s per day, and only gave up possession last week. Included in the claim for balance of wages were some small -items.: for repairs, and after hearing counsel and:evidence, his Worship gave judgment for--.plain-tiff for £2 14s lOd, the amount expended by him for extras, with costs £S Bs.
