February 22. The coal export for the week ended Saturday was 4986 tons. DUNEDIN .•-*,_.'.:_.- February 22. The Insuranoe oase, Smith v London and Liverpool and Globe Insurance Oompany was concluded latefon Saturday. The claim was for £1000, . amount of policy of . insurance* effected with the company on plaintiffs stock and fittings destroyed by fire. The defence put forward was that plaintiff failed to give as accurate and particular acoountof loss bb the case would admit of within I*s days ; that there was fraud and overcharge and imposition on the part of the plaintiff ; that a fal-te declaration was made by him in Btating that goods to the value of £1912 8s Id were burnt, and that the loss amounted to a very muoh smaller sum. The Jury after four hoars deliberation found, all issues in favor of plaintiff, and gave a verdiot for the full amount claimed. The jury first found the value of stook and fittings to be £1650, and o ß^ v -.*- hat the de fe &<3 a&ts share would be £850, but it was pointed out that plaintiff possibly might not succeed against other companies concerned, and that the Jury had not to apportion damage between two companies, as that could be subsequently adjusted. A full verdict for plaintiff was then given, leave being reoeived by the Company's council to move to set aside the judgment.
