M'Lean.—This was an in formation laid by Benjamin Hurfit against the defendant,,who : is a contractor, charging him with assaulting tho complainant at the Pro* vincial Hotel. Mr Pitt appeared for Hurfit, and Mr Bunny for M'Lean. From! the evi> dence it appeared that Hurfit went to the hotel, where he met the defendant, and presented to him some orders for money, and demanded payment. Au altei'cation ensued, and Hurfit got the worst of it. The-Bench considered that the complainant had bean aggressive, and therefore fined the defendant 10i, but declined td allow costs. Aitken v. Ait ken.—This was an information laid by Mrs Attkon against her husband, Eobt. Aitkon, charging him with having threatened to break her neck, and requesting that the defendant should be bound over to keep the j peace. Mr Buuny appeared for the complainant, but, hit* client did not appear to give evidence. Mr P. Adams, for the defendant, said he was prepared with witnesses to show that, all that actually transpired whs owing to the conduce of Mrs Aitken, who neglected her household duties', and made things bo miserable that the children actually be^god their father to gefc rid of her. He complained of tbe injustice done his client by tha complainant not appearing. Tha c.tao wao dismissed. T. Menary v. 3-rant.—This was a claim upon a dishonored cheque, but the plaintiff not offering any evidence, he was nonsuited with costs. Winetanloy v. Conway.—Mr P. Adams appeared for the plaintiff, who claimed £12 3a 4d for goods euppliod, and obtained judgment with oosto. I G. Stevenson v. J. Crichton.—Mr Percy Adams, for the plaintiff, claimed £3 8s for covering fees, and obtained judgment with costs £1 17s.
