(No. 1.) COPY OF SIR. TRAVERS NOTE.
Nelson, oth August, 1859. Dear Sir, —In reply to your enquiry as to the 2>th paragraph of Mr. Blackburrow's letter in the Xfoionist of this day, I beg to say— Ist. That 1 advised Mr. Shipley not to give a in the suit brought by you against him, •on two grounds; firstly, that he ought not to give ;you a priority over his .other creditors, and secondly, because he disputed a portion of your claim. 2nd. When your counsel applied for judgment 3n default of plea, I undertook, on behalf of Mr. 'Shipley, that he should give a cognovit provided •the claim was reduced to the amount admitted by Mr. Shipley, which was acceded to by your counsel. 3r-d. After your counsel had, on the faith of my undertaking, withdrawn his application, I had very great difficulty in getting Mi-. Shipley to execute the cognovit, and it was not until I had repeatedly threatened to. throw up the case, that I succeeded in getting it signed. I may add that so far as the matter came under my'cognizance, both you and Mr. Adams acted with courtesy and forbearance. Yours truly, William Thos. Locke Travers. To Mr. Harley, - Nelson.
