RESIDENT MAGISTRATE'S COURT,
Wednesday, June 30. Before J. Poynteb, Esq., Resident Magistrate. SMAIiL DEBTS CASES. Baly v. Kiernan.—ln this case an action was brought by Mr. Baly for the value of certain articles supplied by him to Mr. Lang*brd, who bought them for Mr. Kiernan. Mr. Kiernan, who it appeared knew nothing of any person but Mr. Langford in the transaction, produced a receipt of his payment in cash for the goods, signed by Mr. Langford. The case was adjourned with the view to settlement out of court.
Dartnell v. Stone.—-This was an action brought to recover the amount of a dishonored acceptance. Mr. Hume, who appeared as agent for Mr. Dartnell, had neglected to produce evidence" sufficient, but by adjourning the case for an hour, Mr. Dartnell's brother was sworn, who deposed to the handwriting, and established'the case. Verdict for the plaintiff. Scott v. Macdonald.—This was an action brought by a passenger of the Camilla, for money due on account of work and labour done and performed on board the ship during her passage. Thomas Scott on being sworn, stated that he was a passenger on board the Camilla; he was requested to assist in making a new maio topmast and other spars, and also in repairing the binnacle and skylights. The captain promised to pay him, and he charged 15s. a day from ignorance of the colonial rate of wages. Mr. Kingdon, for the defendant, did not object to some remuneration, though not the amount. Judgment for Bd. per diem for the time at work. Martin v. Macdonald.—This was a similar case to the above, but as the plaintiff had not been by trade a carpenter, the worthy Magistrate allowed ss. per day for time employed. Phillips v. Franklin.—The plaintiff produced his books in this case and proved his debt. Verdict accordingly.
