Harris sworn, said : In September, 1855, 1 worked 4 days 2 hours for the defendant; I was lathing the inside of a house; I also measured some work for him subsequently ; I have charged at the rate of 12s. per 'day. John Ladd sworn, said: I produce a set-off; the plaintiff had 4 bundles of laths of me at that time ; he.also took away a new sieve belonging to me for which I charge 10s.; lie took also a bucket and a small tool, worth together Is. 6d. The Magistrate said he would give judgment for plaintiff for £il4s., and costs.
