OBJECTION SUSTAINED

CROWN LAW OFFICE DECISION ELIGIBILITY OF MR J. OLIPHANT Mr V. A. De Coak, who was counsel for some ratepayers who launched appeals against the recent Borough Re-valuations, has received decision to an objection which ha launched in the Hamilton Land Valuation Court in Te Awamutu recently. The reply from the deputy registrar of the Land Valuation Court in Hamilton states that Crown Law opinion had been obtained as to the eligibility of Mr J. Oliphant sitting as a member of the Hamilton Land Valuation Court in Te Awamutu to hear objections when both he and his wife owned considerable property in the district. “It has been ruled that Counsel’s objection to Mr Oliphant adjudicating in such circumstances should be upheld, and such being the case the other members of the committee and the Borough Assessor (Mr S. H. Wanklyn) will be asked to make the necessary decisions from the notes of evidence which they made,” the advice states. The Committee’s findings have not yet been made available.
