NO HOLIDAY

ANNIVERSARY DAY GOVERNMENT’S DECISION In view of the emergency situation, the Government has decided to cancel the observance of Anniversary Day as a holiday in the Wellington and Auckland Provinces. Anniversary Day is observed in the Wellington Province on January 22 and in the Auckland on January 29. Similar steps will be taken in respect of other provinces as holidays occur, if it is considered necessary. It is pointed out that Anniversary Day is not observed as a holiday in accordance with statute law, although it has been the custom for many industries and business premises to observe a holiday on that day. Some awards of the Court of Arbitration make provision for a holiday on Anniversary Days, while others do not. Where no provision is made in awards or agreements, work has been done in the past on Anniversary Day. In some awards where Anniversary Day is not prescribed as a holiday, some other day is substituted. It is therefore considered officially that where an award or agreement makes provision for any special payment or other condition if work is performed on the holiday, such special payment or other condition should be granted subject to the Overtime and Holidays Labour Legislation Suspension Order, 1941, which removes treble-time payment for work on holidays.
