Magistrate’s Court

TE AROHA—TUESDAY (Before Mr F. J. Burgess S.M.) Roland v Odium. Judgment was given for plaintiff for £5 3s 7d with costs 24s 6d. DRUNK AND DISORDERLY Two Maoris, McCaskell and Meta were charged with being drunk and disorderly on September 16 th. McCaskill was fined 10s and 26s costs Meta being ordered to pay costs 265. J. B. Morrison v I. Simson claim for balance of account L 42 8s 2d for work carried out in connection with the erection of a house and outbuilding, Mr G. H. Nicholls appeared for plaintiff and Mr T. H. Moresby for defendant.

Plaintiff gave evidence to the effect that defendant had instructed him to build a house for him out of material supplied from an old house, no contract price being fixed. On completion of the house defendant objected to pay the full cost of labour and painting etc., considering the charge too high. Lengthy evidence was given to show that the work had been carried out.

Judgment was given for plaintiff for L 4 4s 6d with costs L 4 19s, defendant having paid L3l into court prior to the hearing.
