(Befohe His Hosoa CulEf Justice Chambers). 28th October. Maposua -Leota and others French Catholic Mission. The argument of Mr. Gurr, on behalf of the defendants, occupied all the forenoon sittings. Mr. Hether-ington-Carruthers argument for the plaintiffs has not yvt been heard, other fixtures having beeu taken up. 29thTapuala Moeauvai vs. Tapuala Tipa. Mr. Gurr for defendant. Claim to a piece of land called Faletaoiga in Savaii. Judgment for defendant who was ordered to reimburse plaintiff the amount of costs incurred by him in defending the title before the Land Commission. 31st. • Government of Samoa vs. Faatonu and Fua. Charge of assault and attempted abduction under Samoan Criminal Code. The evidence showed that Faatonu had used force in attempting to carry out hi l * purpose, and that he was assisted by Fua. The attempt was committed sbo.-tly after dark upon the public road. His Honor after commenting severely upon the heinousness of the offence, and stating that it was the duty of the officers of the law, and judicial officers to take steps to bring about such a state of things that women might pass along the roads free from molest at ion or itisuh, and that it was evident that an example was necessary sentenced Faatonu to 3 years and Fua to 1 year's imprisonment with hard labour.
Ist November. E. F. Allen, vs. Gret'smuhl and natives of Fagapoa, Mr. HHherington Carruthors and Mr. Unrrfur plaintiff. Claim in detinue and for broach of contract. The Samoa n defendants admitted the breach and agrtted to pay $l5O for damages and coats, and to immediately deliver to plaintiff the quantity of copra claimed. Agreement approved by the Court. His Honor tr*atlng ihe damages and cost a as penal for disregard of former judgment. Judgment in accordance with agreement. 4th. I). H. & P. G. Chiefs and Rulers of Vailoa and tomuli. Action to recover money advanced in the year 1887 secured by mortgages, Mr. Hetheringtnn - Carruthers ami Mr. Gurr for plaintiffs. The evidence of Messrs. Katimann, Kdnig, F. vVilson, and E. W. Gurr wns taken for plaintiffs. An agreement being practically a confession of judgment by v tiilo» was* tiled. The chiefs of Vaitotnuli failed to appear. Judgment against Vailc a in accordance with agreement for S4OO inclusive of casts, and against Vaitoruuli for $498 also inclusive of cost c ■ ■ Government of Samoa (Ah Oiling complainant) Migao. Charge of violent assault upon Ah Obing. Mr. Hothnrington * Carruthers for prosecution, Mr. Gurr for defence. uTH NuVEMBRR. The above case was continued ahd prisoner found guilty und sentenced to pay 960 for compensation to complainant and co»*ti* of trial, otherwise to be Imprisoned with hora labour for nine months.
