MISREPRESENTATION.
A FARM EXCHANGE.
Press Association. AUCKLAND, March 4. At tho Supremo Court to-day the action was concluded in which Thomas and William Brown, farmers, Te Awarnutu, claimed from Joseph Thornos, formerly a land agent, £3BOO as damages for alleged misrepresentation in connection with the exchange of a farm at Opotiki for one at Gordonton, near Hamilton. The case for the plaintiffs was that tho manager of the defendant's Hamilton branch made certain representations regarding the Gordonton property that induced them to exchange, and that such representations were not in accordance with fact. The jury fouud that all but ouo of the representations complained of were untrue, and in answer to the issue, "Were they made fraudulently or negligently?" returned a reply, "Negligently." The jury awarded £2383 damages and £IOO for labour and material. The Judge said that although judgment was given against Thornes it was not in respect of anything improper done by him, but because he was responsible for the acts of his servant.
