SUPREME COURT.

A RATING QUESTION. The hearing was resumed in the Supreme Court by his Honour Mr Justice Sim to-day of the case of Fletcher and others v. the Wainono Drainage Board. This was an originating summons brought to determine certain questions as to the inclusion of the .plaintiffs in the board district, and the classification of his land for rating purposes. Plaintiffs also questioned the legality of certain special loans, and the rates made to secure the repayment of interest in connection with them.

Messrs Kinncrney (of Waimate), and Lucas (of Timaru) appeared for the plaintiffs, and Mr S. G. Raymond, K.C., with him Mr Twyneham (instructed by Hamilton and Fitch of Waimate) for the defendant board. The evidence had all been taken by affidavit, and the present hearing was confined to leg:-' argument on the facts disclosed.

Mr Kinnerney concluded his arguments this morning. Mr Raymond repealed his contention (made at the opening of the case) that the proceedings were wrong, and that the procedure by which plain!iffs sought relief was not the procedure that in a case of this kind the court should, as a matter of discretion, give encouragement to.
