COUNTY COUNCILS. A I PAR A COUNTY COUNCIL The Waipara County Council, in pursuance of the powers in that behalf vested in it by virtue ol' "The Counties Act, 1908," and all other powers them thereunto enabling, doth hereby MAKE - and ORDAIN the following BY-LAW: — 1. This By-lay may be shortly cited as "The Motor Drivers' By-law, 1915/' 2. No person except as hereinafter mentioned shall after the expiration of two calendar months after the coming into operation of this By-law drive any Motor Car or Motor Cycle "within the County of Waipnra unless he shall have previously satisfied the Inspector appointed by the Council of his ability to efficiently handle a Motor Car or Motor Cycle (as the case may be), and has applied for and obtained , a Certificate to that effect. Provided always that this clause shall not apply, to Visitors driving their own cars or motor cycles within the County, nor to any Chauffeur, Mechanic, or other person over tha age of sixteen years employed to drive a Motor Car by such Visitor nor to Learners driving cars under the supervision of a person holding such Certificate. For the purpose of this Section, "Visitor" means (with • reference to a motor car) a person above tlie age of sixteen years and (with reference to a motor cycle) a person above the age of fifteen years whose usual place of abode is more than one hundred miles from the .Waipara County and has not been temporarily away from, such place of abode a longer period than twenty-eight days. 3. No Certificate of Ability in regard to a motor car shall be issued to any person under the age of sixteen years, nor In regard to a motor cycle to any person under the age of fifteen years, but persons between the age of fifteen and sixteen years may drive a motor car in the County under the supervision of a person holding a Certificate of Ability to drive a motor car issued under this By-law. 4. Every Person desirous of obtaining a Certificate of Ability to drive a motor car or motor cycle shall make application in writing to the County Clerk in the form No. I. in the Schedule hereto. Every such Certificate shall be in the form No. 11. in the Schedule hereto.

5. (1) The Fee for every sucli Certificate shall be Five Shillings in the case of a motor cycle and Ten Shillings in the case of a Motor Car, except that in the case of more than one member of a family residing together under one roof for at least twelve months prior to the date of application applying-for a Certificate of Ability to drive a motor car the fee shall be Five Shillings for each such Certificate. For the purposes of this Section "Family" shall mean and include a husband and wife, a widower or widow and their, his, or her sons and daughters. (2) Provided always that every person who is the holder of a License to drive or a Certificate of Ability to drive a motor car or motor cycle granted under or by virtue of any Act for the time being in force in New Zealand, or under any By-law of any Local Authority in "New Zealand, shall, on production of such License or Certificate, and on proof of his identity as such holder and payment by him of the difference (if any) between the amount of the fee paid by him on the issue of such License or Certificate and the amount which would otherwise have been payable by him for a Certificate of Ability under this By-law, be entitled to receive a Certificate of Ability hereunder. 6. Every Certificate of Ability issued hereunder shall remain in force until cancelled by the Couticil Oh either of the following grounds:— (1) If the holder shall be or become physically unfit for driving and attending to a motor car or motor cycle. (2) If the Council or any • Committee 1 thereof to whom the matter may be referred be of opinion that the holder is no longer a fit and proper person to hold a Certificate of Ability or to. be entrusted with the driving of a motor car or motor, cycles (3) If the holder has been convicted twice by any competent Court in the Dominion of driving a motor car or motor cycle to the danger of the public. (4) If the holder has been convicted by a competent Court in the Dominion at least three times of any offences> in regard to the driving of a motor car or motor cycle, including offences not involving danger to the public, provided that before cancelling any such Certificate the Council shall give the holder a reasonable opportunity of being heard in regard to the proposed , cancellation. ' *

7. Every holder of a Certificate.of Ability to drive a motor car or motor cycle shall, when driving or in charge of a motor car or motor cycle in the County, produce such Certificate on request by the Inspector or by any Police Constable, and if not in posession of the Certificate shall, on a like request, gjve his or her name and address and produce such Certificate to such Inspector or Constable for inspection within fortyeight hours of such request. 8. On proof of loss of any Certificate of Ability the ppson to whom the same shall have been issued shall be entitled to a duplicate thereof on payment of one shilling. 9. Any person committing a breach of any provision of this By-law shall be liable to a penalty not exceeding-five pounds. The above By-law , was made by Special Order of the Waipara County Council by Resolution passed at a Special Meeting of the said Council held on the 30th day of October 1915, and Confirmed at a subsequent Meeting of .the said Council on the 24th day of December, 1915. The Common Seal of the Chairman, Councillors, and Inhabitants of the County of Waipara was hereto affixed on the 24th day of December, 1915, pursuant to a Resolution of the Waipara County Council, in the presence of RICHARD EVANS, Chairman.
