COURT OF APPEAL.
Press Association. WELLINGTON, April 6. The Appeal Court .opened to-day, the Chief Justice (Sir Bobert Stout), Mr Justice Denniston, Mr Justice Edwards, and Mr Justiee Sim being on the bench. There is a long list of cases, and fixtures were made for the first three days of this week, then the court adjourns to the" 19th. Leave to appeal to the Privy Council was granted in the cases of the Union Steam Ship Company v. the Wellington Harbour Board, and Acton Adams y. Eutherford. THE CASE OF HOLLAND. The Appeal Court is hearing the case of*H. Holland. The prisoner was found guilty of sedition for a speech delivered during the strike, and the Chief Justice reserved for the Appeal Court two question:—(l) Whether the first indictment disclosed an offence; (2) whether the fact that the prisoner had been acquitted by the Magistrate on a summary charge of inciting to resist the police, and that the evidence' in proof of that charge was the uttering of the words in the second indictment, prevented his being Gonvieted of sedition. The preliminary question was whether a plea of autrefois acqunt Could be made after a plea of not guilty, on indictment. The Solicitor-General is appearing for the- Crown, and Messrs T. M. Wilford and P. J. O'Began for the prisoner. Argument is proceeding.
