A COMPLEX CASE.
THE AFFAIRS OF A PAPER. Press Association. WELLINGTON, March 30. The hearing of the action, Lloyd Cox, journalist, versus Peter Heyes and Joseph M'Cluggage, a claim for £437 with interest and damages, is occupying the attention of the Supreme Court. Plaintiff was appointed to conduct the Wh'angarei " Advocate," taken over from Mr H. Mander, M.P., by defendants. Two qualifications required of Cox were . that he should possess the goodwill of - Sir Joseph Ward, then Premier, who was interested in the paper, and invest £SOO xn the business. In due course the company was registered, and the paper .ran for two years, when, it was alleged, Heyes drew out of the working account large sums of money, giving Mr Mander a promissory note in the name of the company for £250, the balance of the purchase money. The business was being penalised by the transfer 3f the money to Wellington. Later, defendants mortgaged the assets of the company to J. D. Sievwright for £2o=lo, and, proceeded to pay disputed claims. The- plaintiff was dismissed and Seivwright was appointed manager. Plaintiff claimed for the difference in the value of the shares thus brought about,, with interest and damages.
