James Hanley, Richard Olliver, and Augustus Barrett appeared to answer to a charge of stealing a boat valued a('£s, the property of Thomas Lamont, of New Brighton. Mr A. T. Donnelly appeared for the two first accused. Lamont gave evidence that he had missed his craft about the first week in Januarv. On January-15 he saw his boat at Herring Bay. It "had changed its colour from red to yellow'' and the pain Ling had palpably been done in a hurrv. It was padlocked to a post on the river bank. The three boys had explained that they had been given permission to use the boat by another man.' ; The constable in charge at New Brighton gave evidence as to his having cav.ght the three youths red-handed iy vhc boat. He had seen them rowing i towards Sumner, and had pursued them in another boat three miles down- the cstv.ary. He stopped them and made them tow him back again. The boys had two bicycles in their boat, and intended :to disembark at Sumner. Mr Donnelly contended that the three yorZ-hs were not definitely connected wiili the £>oat..
