CLAIM FOR DAMAGES
MISSING SPLIT-PIN CAUSED ACCIDENT PASSENGER SUES DRIVER Arising out of ac accident at the Pipiroa Ferry, near Thames, on Janu ary 9. a claim for £3OO damages was heard before Mr. E- C. Cutten, S.M.. at the Magistrate’s Court yesterday. Rose Fellowes (Mr. Sullivan) claimed £3OO damages from a tax. driver, C. B. Adcock /'Mr. ‘laddon; Plaintiff, a passenger in defendant’s car, received injuries whicl were ai legedly caused through negligence or defendant’s part. In giving judgment for defendan the magistrate said that according to evidence the accident was caused by the loosening of the tie-re-3 connect ing the two front wheels, the vehicle becoming unmanageaM and upsetting. The car was a new one and the driver could scarcely be expected to look fo T such a defect. The position would be different if the brakes were at fault, because he would know they were nor efficient, and if lie. ccntiuued to drive the car he would be taking an undu* risk.
