BROTHERS’ DISPUTE
BANKRUPT SEEKS DISCHARGE The petition of Christian Henrv Hubi for a discharge from bankrup cy w’us adjourned for further information, when it came before Air. Justice Smith in the Supreme Court yesterday. Supporting the petition. Air. Sullivan said that bankrupt and his brother had been farming in partnership between 1922 and 1925. The first and second mortgages on the property were £ 2,500 and £1.900 respectively, and on dissolution of the partnership, the brother, Ernest, took over c. third mortgage of £3OO. Bankrup sold some of the stock, and being unable to give a satisfactory explanation of what became of the proceeds, he was prosecuted and placed on probation. Opposing tlie petition, Air. Glaister stated that the bankrupt had openly boasted he would swindle his brother out of the mortgage. Under cross-examination, Dubi refuted the suggestion that lie had pushed his brother out of the partnership. On receiving the proceeds of V the Stock amounting to a-947, he had paid the unsecured creditors, who were trying to help him. He believed that his brother bad no claim over him. He added that when he appeared in Court for a breach of the Bankruptcy Act he had pleaded guilty to anything he thought was right.
