ARRANGEMENT BEFORE DEATH The validity of a gift of £4OO. made by a mother to her daughter shortly before the former’s demise, was upheld by Mr. Justice Ostler in the Supreme Court yesterday, in a reserved judgment. The issue came before the court under an originating summons issued by Mrs. Gladys Beatrice Bartlett against the Public Trustee, as executor of the estate of Mrs. Mary Jane Davey, her mother. His Honour said that in October, 1928, Mrs. Davey had informed her daughter that she had to undergo an operation, and even if she survived it, she did not expect to live long. After making her will, Mrs. Davey handed her banker a deposit slip for £4OO that she had lodged, stating that in the event of her death he was to give the slip to her daughter. Mrs. Davey later signed a document to that effect. Her death occurred the same month. The judge added he had no doubt that Mrs. Davey intended that the £4OO should so to her daughter.
