ARCHITECT SUED

MOTOR ACCIDENT RESULTS IN CLAIM FOR DAMAGES INJURIES TO SIGNALMAN Damages amounting to £933 were claimed in the Supreme Court this morning before Mr. Justice Smith and a jury by Edward Frances Hickey, a signalman at Newmarket Station, against Hugh C. Grierson, architect, as a result of injuries suffered by plaintiff in a collision on the evening of December 29 of last year. Mr. Mabee appeared for plaintiff and Mr. West for defendant. Details of the claim are: £l9 medical expenses, £8 to damage to bicycle and £750 for general damages. According to the statement of claim, plaintiff was riding his bicycle from Mapau Road, Green Lane, into Great South Road, when he was struck by defendant’s car, which was going along the main road toward the south. It was alleged that defendant drove his cat* negligently and struck plaintiff’s cycle with great force, throwing plaintiff off and inflicting serious injuries, which had meant the loss cf six months’ work. It was held that his general health had been permanently injured. Mr. Noble said defendant was on his wrong side and on striking the bicycle plaintiff was thrown in to the bonnet of the car. The car went 90 feet before it pulled up. Plaintiff was in hospital for six weeks. Cross-examined by Mr. Weston, plaintiff said lie had no recollection of telling a policeman that he saw the car coming along the road on its right side. Defendant visited him at hospital and said: “Don’t worry; I will pay the expenses.” Dr. Carew, who attended plaintiff, said the injuries suffeYed to plaintiff’s ribs and muscles were such that plaintiff could not lift any heavy weights and it was not likely that his condition would improve a great deal.
