TRESPASS BY ANIMALS
FARMER AWARDED DAMAGES (From Our Own Cori'espondent) OPOTIKI, Saturday. A case of considerable interest to farmers was heard at the monthly sitting of the Opot'ki Magistrate’s Court, when Slialfoon Bros. (Mr. Hodgson) sued Te Roihe Pakira, of Waimaua (Mr. Murray) for £25 damages for trespass of defendant’s bull and pigs on plaintiff’s farm at Waimana. Plaintiff’s case was that defendant was an adjoining farmer, but his fences were in bad order and he would not look after his stock, and plaintiff had suffered from trespass for some years. Defendant admitted that his stock had trespassed repeatedly on plaintiffs’ property, but said that he had suffered from plaintiffs’ pigs trespassing. He submitted that plaintiffs' fences were not legal fences. Judgment was given for the plaintiffs for the full amount claimed,, £25, and costs £9 10s 6d.
