CITIZENS' CLAIM FAILS IN DUNEDIN Press Association DUNEDIN, Monday. The decision of Mr. Justice Adams in the Royal Arcade case was promulgated this morning. He has decided that the people of Dunedin have not established a public highway through the arcade. The action was taken by the Attorney-General, acting for the citizens, against the Arcade Company, seeking a declaration that the arcade was a public highway. His Honour, after a lengthy review, held that all the evidence was consistent with the view that public usage had been by permission of the persons in possession, and in that view only was the action of the public and the corporation since the year 1866 satisfactorily explained. Plaintiff had failed to establish dedication, and the action was dismissed with costs.
