breach of contract claim Press Association DUNEDIN, To-day. A claim for £7,000 for breach of contract was heard before Mr. Justice MacGregor iu the Supreme Court this morning, plaintiffs being Welby Earle Pi'-.her, a medical practitioner, of Taumarunui, and Circulation, L,td„ manufacturers of water - heaters, Auckland, and defendants, Methvens, Ltd., brassfounders, Dunedin. Messrs. West (Auckland) and Gordon (Taumarunui) represented the elaintiffs. who stated that from 1924 to 1926 defendants had manufactured and sold to plaintiffs and others 300 Fisher Twin circulators, and in neatly all cases had, without the consent of the patentee or the plaintiff company, caused a hole to be bored which nullified the effect of the patentee’s contrivance, causing loss and damage in rectifying as well as loss of overseas trade. Counsels statement was that Methven s, who were to exploit the invention commercially, failed to manufacture to design. The case is proceeding.
