CASE NOT JUSTIFIED
JUDGE’S STRONG COMMENT NEEDLESS EXPENSE (f rom Our Own Correspondent) HAMILTON, Wednesday. ‘‘There is not the slightest justification for these proceedings, and I cannot express too strongly my disapproval of them,” commented Mr. Justice Herdman, in strongly rebuking Mr. W. Noble, of Te Kuiti. for instituting a Supreme Court action on behalf of a plaintiff at Hamilton to-day. “The extraordinary feature,” proceeded his Honour, “is that defendant was about to exercise his power of sale when negotiations were entered into with the mortgagor for a settlement, the terms of which were signed by Mr. Noble, acting for the plaintiff, when he withdrew, imputing misrepresentation. By the execution of a document making complete retractions how plaintiff has been put to the expense of a baseless Supreme Court action, alleging misrepresentation, it is for his solicitor to explain. The unfortunate man will have to pay the costs of litigation in which he had no right to be involved, and his solicitor must accept the responsibility.”
