“STATE MUST PAY”
.MAINTENANCE PUZZLE PATERNITY DENIED When A. W. Hooker, a naval man, appeared before the Onehunga Police Court yesterday, he denied paternity of a chiid. Hooker wal married in Christchurch in 1923 and went to sea a few days afterwards. When he returned home his wife was not there, and he had not seen her since. In February, 1926, a child was born, which was afterwards committed to a State home and she consented to an order for 10s a week maintenance. She had defaulted in payment* and could not be found, so the State had summoned her husband, who denied paternity. The magistrate said that the only evidence he had was the child in the home, as Hooker was debarrt d by law from giving evidence. “You can only prove that Hooker was married to the woman. She does not claim that Hooker is her husband, although the child was born in wedlock. The birth certificate states that the child is illegitimate. Mrs. Hooker had the cover of her husband’s name, but did not use it. and it is pretty hard on Hooker to have to maintain the child. There is no evidence connecting Hooker with the child. The State will have to pay. I must dismiss the case without prejudice, not being satisfied with the
