A ROAD BOUNDARY
DEFINITION WANTED AN INVOLVED ACTION An application for the definition of a road boundary affecting the encroachment, if any, of private property u P°n. a public road in the Howick district was heard before the Chief Justice, His Honour Mr. Justice Skerrett, this morning. The Attorney-General (Mr. Prendergast) was the plaintiff in the action, and the defendants were W. H. Nicholas and Shaw Bros., for whom Mr. T. Holmden and Mr. J. Armistead respectively appeared. Mr. V. N. Hubble appeared on behalf of the District Land Registrar.
The plaintiff, Mr. Prendergast, stated that the claim was an oldstanding one. The Manukau County Council, the local body concerned, needed a full-width road, but at the point in question it was not known whether Nicholas or Shaw Bros, were responsible. Both parties should have been joined years ago, when the Paparoa Road Board was merged in the Manukau County Council. The action was to determine who was responsible for the encroachment, if any. Mr. Hubble said that the District Land Registrar had joined the action in order to be bro Light under the ruling of the court, and would be pleased to do what he could to assist either of the parties concerned.
