MINOR IN COURT
PURCHASE OF MOTOR CYCLE. At the Stratford Court this morning reserved judgment was given by Mr. R. W. Tajte S.M., in the case in which, the Taranaki Trade Association, as assignees of LightbandJ and Warm (Mr. Moss) sued Bertram 1. Stanford (Mr. Coleman) for £42 3s for unpaid installments on the purchase of a motor cycle and repairs and accessories thereto. Defendant pleaded infancy. Plaintiff contended that the goods supplied were necessaries and outside the prohibition; that in the agreement the defendant had represented himself of full age; and that the Court should give plaintiff relief in equity and good conscience, Mr. Tate said he could not agree that any part of the claim wafe for ncessaries. As regards misrepresentation Sir John Salmond 1 laid it down that deliberate lying would not make the minor any more liable on the contract produced by the falsehood. Plaintiff must fail on his second contention, also on. his third. Judgment would be entered for defendant. Costs of £3 3s allowed.
