Accused’s counsel, when the, pro* cetidings opened, said the accused intended to plead not guilty, I Dr. Macky, of the hospital, who examined the patient, said he would believe the pitieht’s story as his word could; be relied on. .:>% William' Mosley, an attendant at the hospital, maintained that the pat-
