Mr Iliildell, S.M., fit Wellington, decided an important point in a cnil claim for £IOO on a p-omissory note given as collateral -.security on a mortgage. Defendant pleaded tlie Mortagcs Extension Act. I lie Magistrate held that plaintiff’s demand on the promissory note was .equivalent to one for payment of principal due under a mortgage. Section 3 of the Mortgages Extension Act, which, inter alia, required a mortgagee to obtain the leave of the Supreme Court before a demand foi payment of a principal sum or any part of that sum secured by a mortgage, therefore applied. Plaintiff must comply with that provision. P.A.
