Midford applied for a criminal information against Dewendt Fenton, editor of the “Sporting Times,” foi libel in charging Midford with a grave offence, resulting in separation from ins wife. The latter, in an affectionate letter to Lady did not give her reason for leaving her husband. The Chief Justice refused the application, which is only granted to those occupying a public office. Private persons, however grave the libel, should to a criminal information.
