LIQUOR PROSECUTION FAILS. TPeb Press Association.] Invercargill, May 20. A judgment of importance in nolicense districts was delivered by Mr Huteheson, S.M., to-day. Victor Coleman, landlord of the Club Hotel was charged with keeping such premises as a place of resort :"or the consumption of intoxicating liquor. The facts were not disputed. One of the rooms was fitted up as a temperance bar, which is the resort of many, who bring with them" alcoholic liquor, which they consume 'hecs. His Worship said that if seetnn 37 could be read as making +jie permitting of a place to be used as a resort for the consumption of intoxicants, the defendant must haVe been Hfxmvicted, but sie section could not be so construed. "It is the purpose for which the defendant keeps the bar, and not the purpose which other people may have in coming which is the essential point," the Magistrate concluded. "It is not only not suggested that the defendant keeps the bar for the purpose of the consumption of intoxicants, but such view "a expressly repudiated by the prosecution." The case was dismissed.
