CONFESSED JUDGMENT.
Wellington, October 14
Before the Magistrates’ Court, after the civil list was finished to-day, Dr. A. McArthur, S.M., said that he wished to make a statement with reference to a publication which had been shown to him. In it a list of those persons who had confessed or consented to judgment in the Magistrate’s Court was published. < ‘*Now it has . always .been my practice from the time that I came,” continued his Worship,” that fouch lists should not be given out of our bookjj at all. I have expressed the opinion that the Court is decidedly opposed to any such publication 'whatever. Under the right ‘of search and rule 58 of the Magistrates’ Court Act the magistrate has the -right to control the conduct of the'office, and I have always forbidden (and I have every reason to believe that my instructions have been, carried out by the office) that any information as to confessions or consents should not be given out. lam throwing no imputation whatever upon the members of the Press, who report the proceedings here, and whose reports I have observed have been a fair presentation of what has been done. I don ? t consider it fair that any notice whatever should be taken of the names ofi those who have confessed judgment. There is also another point,” continued the magistrate, “my attention has been called 'to what I would designate, as a black list, 1 which provides certain names and - addresses. This black list I consider ian unwarrantable use of means socalled to protect creditors. It pre- ' stents a negative method of stating kllat Certain persons are not financial.”! 1 Concluding, l the magistrate, < id -condemning the publication' reiterated the fact ' that the information -(vas not obtained l from the Gourf: reicords or from the ireporters, i „ i : i' i.'
