HOTEL TRANSFERS.
A NOTE OF WARNING. ,At the adjourned annual meting of the.- Patea Licensing Committee the Chairman (Mr Kenrick, S.M.) voiced a warning to holders of hotel licenses in the matter of transfers. Mr Kenrick spoke as follows: —“It has come under my notice that licensees when disposing of their interests in their license and premises frequently sign an agreement with the in-coming tenant that the matter must be completed by a given dte, and in so doing they do not allow themselves time to comply with the requirements of the Licensing Act before the matter must' be completed under the agreement, namely, sufficient time is not allowed to obtain a Magistrate’s certificate, a temporary and permanent transfer. The latter transfer has to be advertised three times before 21 clear days of the quarterly meeting and the application has to be lodged 21 clear days before the meeting. “To get over this difficulty application is made to the Committee for a certificate of waiver under Section 292. This is not a proper proceeding, that section being only intended to be used where something has been neglected or omitted to be done, but not wilfully. K ,, ••
“To dispose ,of a license apd provide that the matter must be completed at a date which: makes it impossible to comply with; ■the requirements of the Act is not:a neglect or, omission under Section 292, and a certificate cannot bo given to waive what has been deliberately done.’.’
