Wellington, November 1. hi the special taso of iitcvdlhly and Co. v. tf.oJin .McLean and Son, litigation arisiug out of tho stopping ol the Wellington Dock contract, the Chief Justice held that there was no undertaking on tho part of defendants to order sand and gravel beyond what was required. Counsel for defendants asked for judgment on the claim for £20,000, contending that the effect of Sir Robert Stout's decision was that plaintiffs had no cause for action. *Tho motion for judgment was deferred till Wednesday next.
