APPEAL COURT.

(Per Press Association) Wellington, August 7. In Dummer and Others v. Shaw, Savill and Albion Co., the Court of Appeal was unanimously of opinion that tlie company Jiad no right to impose tho conditions printed on the ticket in contravention of section 320 of the Imperial Merchant Shipping Act, of 1894, and tfiey were therefore invalid. The Court was further of opinion that the accident was not caused by negligence in navigation. Judgment was ordered to i>e entered for plaintiff on the damages assessed by tlie jury in the Court below, with cost’s •in that Court according to scale, with witnesses’ expenses and disbursements, and costs in the Court of Appeal on tho highest scale, and as from a distance.
