Justices Williams, Denniston, Sim, and Edwards sat to hear an originating summons, moved into the Appeal Court by agreement between G. P. Donnelly, Hawke’s Bay, and the Commissioner of Taxes. The questions for the Court's consideration arise in connection with the interpretation of section 5G of the Land and Income Assessment Act, 190 S. .By will the testatrix, devised to her husband (plaintiff) all her interests in the Wairnnrama blocks, subject to certain conditions. These conditions are unfulfilled. Plaintiff’s present occupation is by agreement with, trustees until they should require possession thereof for the purpose of sale, subject to payment of interest on certain mortgage moneys secured on the properties.
