His Honor said that, if there had been a breach of contract in England, counsel could 'not proceed in Xew Zealand, but 'Mr, Jellicoe . disagreed with this. His Honor pointed out that the Full Court {.five, judges) had held that the sale was a proper one, and he must bo guided by them.- Plaintiff was mot by this bar in law, and he thought plaintiff could not claim damages in this country, as he was- asking the Supreme Court of Xew Zealand to issue a writ against persons in England, where the contract was made and -broken. Mr. Jcllicoe said ho had been told bv a 'Chancery Judge in England that he conjd sue in Xew Zealand. His Honor said lie would try and deliver judgment on Thursday morning.
