ALLEGED BREACH OF CONTRACT. By Telegraph.—Press Association. Wellington, Last Xicht. T 1 io affairs of Joshua Jones, of Moko farmer, were before the Chief Justice t day, when Ids counsel (Mr. E. G. Jellieof mentioned a claim of £IOO,OOO prefer red by Mr. Jones against the executors of Wickham Flowers. Counsel mane a very long statement, reviewing the his tory of the estate. The executors, he said, had an attorney in Xow Zealand, and ho desired to take proceedings. Some of the property, he said, was sold to HFrihan Lewis for ;: £ 14.000, but ho questioned this sale,' and plaintiff claimed redemptipn of,lds prpperr.y. . His Honor said that, if there had been a breach of contract in England, counsel could 'not proceed in Xew Zealand, but 'Mr, Jellicoe . disagreed with this. His Honor pointed out that the Full Court {.five, judges) had held that the sale was a proper one, and he must bo guided by them.- Plaintiff was mot by this bar in law, and he thought plaintiff could not claim damages in this country, as he was- asking the Supreme Court of Xew Zealand to issue a writ against persons in England, where the contract was made and -broken. Mr. Jcllicoe said ho had been told bv a 'Chancery Judge in England that he conjd sue in Xew Zealand. His Honor said lie would try and deliver judgment on Thursday morning.
