(P.A.) LEVIN, November 20. The Levin Racing Club's spring meeting opened today in overcast weather, rain falling after the fourth race, when the track became greasy. APRIL DIRECT CASE Return Of Stakes Sought The now famous April Direct case was again the subject of discussion at the meeting of the committee of the Forbury Park Trotting Club this week. A letter was received from the New Zealand Trotting Conference enclosing a copy of a letter from the appeal judges on the April Direct case. This letter was in reply to a statement by Mr A. G. Neil, solicitor, who appeared for the Forbury Park Committee at the hearing of the appeal, that at the hearing he had not known that the judges were in possession of a written statement from the Trotting Association in regard to the case and had therefore no opportunity to meet it. The reply from the appeal judges said that they had had no written statement from the Trotting Association. The chairman said that strangely enough, in the course of the judgment it was stated, “and after considering a written statement from the association. “Now who are we to believe?” asked the chairman. It was decided to receive the letter. It should be explained that at the May meeting April Direct was first past the post in a race, but was disqualified by the Forbury Park Judicial Committee on the grounds of a change of gear as compared with the first day, and Nightbeam was placed first. The stake money was paid to the owner of Nightbeam and the dividends were also paid out on this horse. An appeal was then made to the New Zealand Trotting Association against the decision of the Forbury Club, and it was upheld and April Direct was placed first. The Forbury Park Club then appealed against this decision to the New Zealand Trotting Conference, which appointed appeal judges, and they dismissed the appeal by the Forbury Park Club and left April Direct as the winner. TROUBLE OVER STAKE MONEY

A letter was received from Messrs Johnston and Kippenberger, solicitors, Rangiora, on behalf of Mr J. W. Brosnan, owner of Nightbeam, in which it was stated that Brosnan had suffered a serious loss in connection with the replacing of April Direct in first posi” tion after the club had disqualified April Direct and placed Nightbeam first. It was explained that Brosnan was now being asked by the Forbury Park Club to refund the stake money of £l3B/12/-. t t , The firm of solicitors now stated that Brosnan was prepared to refund the amount of the stake provided the Forbury Park committee at the same time made him a grant or gratuity of half the amount as a contribution by the club towards the loss which our client has suffered through your clubs It was decided to reply that the club recognized no liability in the matter. Correspondence was also read from Mr G. R. Martin (Gore), who stated that apparently the Forbury Park Club was not making any move to right the injury done to Mrs E. R. Baldwin, owner of April Direct, when her horse had been disqualified last May, and threatening to take legal action to secure the stake money paid to the owner of Nightbeam. The letter was received. It appears that unless the money is refunded to the Forbury Park Club Mrs Baldwin has no redress, as a claim cannot be made according to the law as set out in the Gaming Act. Brosnan’s name can be placed on the forfeit list if he does not refund the stake.
