DAMAGES AND COSTS AWARDED
CLAIMS AGAINST PLAYLAND PROPRIETORS , (United Press Association) WELLINGTON, May 17. Damages and costs totalling £7O were awarded by Mr J. H. Luxford, S.M., in the Magistrate’s Court today at the end of the hearing of claims against Double Grip Tubular Steel Devices Ltd., proprietors of Flayland at the Centennial Exhibition. Claims were made by the Scottish Harriers and Amateur Athletic' Club and Frederick Brailsford Silver, who was in charge of the stall run in Playland by the club, alleged that, with the authority and permission of Henry Seff, director of Playland, it had signwriting painted on two upper, exterior faces of its stall and that the company’s employees wrongly obliterated it. The value of the signwriting, £lO, was claimed. It was also alleged that S. Chapman, an Electrician in the employ of the company, forcibly entered the stall to cut off the electric power, and that it was later found that the company’s employees had severed the wires and been guilty of trespass and gross interference. The ,um of £5O damages was claimed on this count. Silver claimed £75/10/6 from the company, Henry Seff and S. Chapman as damages for the alleged assault.
Giving judgment, the Magistrate said that he believed Silver’s statement about the sign writing and that the club was entitled to the cost thej' were put to in erecting the sign, £lO. No general damages t ould be awarded under this heading. The Magistrate also found for the club in its second claim and awarded tile amount sought, £5O. In the case of Silver’s claim the Magistrate found that an assault had been committed, and that Silver was entitled to £lO from Double Grip Tubular Steel Devices Ltd.
