PARTNERSHIP CLAIM John Wallace, of Mataura (Mr D. A. Bell), proceeded against Donald Coster, of Mataura (Mr H. L. Smith), in the Magistrate’s Court at Gore for settlement of partnership accounts and claimed £3l/17/10. Mr R. C. Abernethy, S.M., presided. Both the plaintiff and the defendant were examined about the terms of partnership and the assets and liabilities of the business. The hearing lasted more than three hours. It was revealed that the dissolution agreement drawn up by counsel for the defendant was unstamped. and. in giving judgment at the end of the case the Magistrate ordered the defendant to pay a fine of £5/1/3.

The Magistrate said that neither he nor a qualified accountant could find evidence to support the plaintiff’s full claim, and the terms of the partnership were not clear He gave judgment for the plaintiff for £2/7/7 and ordered the defendant to pay costs amounting to £5/9/6.
